Short Form Terms & Conditions

For Service Contracts, Estimates & Work Authorizations

  1. Scope of Work

    Western Mechanical Co., Inc. (“Contractor”) will perform the services described in the attached estimate, proposal, or work order. Any additional work not listed will require customer approval and may result in a revised estimate or change order.

  2. Pricing & Additional Charges

    Prices are based on the information available at the time of quoting.

    If unforeseen conditions are discovered, the Contractor will notify the Customer and provide an updated cost before proceeding.

    Emergency service, after-hours work, or special-order parts may incur additional charges.

  3. Scheduling & Access

    Customer agrees to provide:

    • Safe access to equipment and work areas
    • Necessary utilities (electricity, water, etc.)
    • Any required permissions for entry

    Missed appointments or inaccessible work areas may result in trip charges.

  4. Payment Terms

    Payment is due as stated on the invoice or contract.

    Western Mechanical reserves the right to stop work or withhold materials if payments are not made as agreed.

    Deposits may be required on certain projects or special-order equipment.

  5. Changes & Cancellations

    Changes to the scope of work must be approved in writing.

    Cancellations may result in charges for time, materials, restocking fees, or special-order items already purchased.

  6. Warranties

    Workmanship is warranted as stated in the proposal or project contract.

    Manufacturer warranties apply to all equipment and materials.

    Warranties may be voided if:

    • The equipment is altered by others
    • Required maintenance is not performed
    • Improper use or conditions cause failure
  7. Limitation of Liability

    Contractor is not responsible for:

    • Pre-existing system defects
    • Failure caused by age, corrosion, or improper prior installation
    • Damage resulting from delays outside our control
    • Consequential or incidental damages

    The Contractor’s liability is limited to the value of the work performed.

  8. Customer Responsibilities

    Customer agrees to:

    • Provide accurate information regarding equipment and conditions
    • Ensure the job site is safe and accessible
    • Follow instructions for system operation and maintenance
    • Notify Western Mechanical promptly of any concerns
  9. Permits & Code Compliance

    If required, Western Mechanical will obtain permits with the cost included as part of the project pricing unless otherwise noted.

  10. SMS/Text Communication Consent

    By providing a mobile number, Customer agrees to receive service updates, technician arrival notifications, and job-related communication via SMS.

  11. Ownership of Materials

    WesAll installed equipment and materials remain the property of Western Mechanical until paid in full.

    Contractor may remove unpaid materials to the extent allowed by law.

  12. Disputes

    Any disputes will be handled in accordance with New Mexico law.

    Customer agrees to allow Contractor a reasonable opportunity to inspect and correct any workmanship concerns.

  13. Acceptance of Terms

    By signing the estimate, proposal, or work authorization, the Customer acknowledges and agrees to these Terms & Conditions.
